California law [<a href="http://www.leginfo.ca.gov/cgi-bin/displaycode?section=fac&group=31001-32000&file=31101-31109">31108</a>] states that shelters are required to hold strays a minimum of 4 business days if they are open at least one weekend day or a minimum of 6 business days if only open on weekdays. Contra Costa Animal Services keeps two shelters open Tuesday through Saturday and was counting Saturday as a business day when deciding how long to hold a stray dog for possible owner redemption or adoption. The appeals court disagreed and said only weekdays can be considered business days under law.<br />

Elaine Godzak, a former volunteer at the Oceanside animal shelter, said that the agency was violating a 1998 state law (the Hayden Act) by refusing to release those dogs scheduled for euthanasia to rescue groups that asked to take them. Godzak hired a lawyer and threatened to take the Humane Society to court over the matter.<br />

But while Goldstein has agreed to release these dogs to rescue groups he said it will be up to the rescue groups to find out on their own which animals are to be killed. Shelter critics are in talks with San Diego Humane Society but details of the talks are confidential. Elaine Godzak, a former volunteer with the Oceanside North County Humane Society, was at the meeting and is cautiously optimistic but is not ruling out the potential of going to court in the future.<br />

One of the issues to be resolved is how the Humane Society will comply with a state law [Food and Agricultural Code Section <a href="http://www.leginfo.ca.gov/cgi-bin/displaycode?section=fac&group=31001-32000&file=31101-31109" target=_blank>31108(b)</a>] that requires it to allow rescue groups to take any animals that are scheduled to be euthanized.<br />

The Coast News reports that 45 dogs evaluated and approved for adoption prior to the merger were transferred to the San Diego facility for re-evaluation and 5 of them were euthanized.<br />

Laura Maloney (Senior Vice President of strategic initiatives and communication for the San Diego Humane Society) stated that out of 45 animals from the Oceanside site that were re-evaluated by San Diego Humane, five were euthanized because of concerns for the community. Behavior assessment proved the dogs to be a potential danger to people or a significant danger to animals.<br />

The Coast News also reported that San Diego Humane and North County Humane use the same medical and behavior assessments for animals but comments from a reader stated that the two facilities <b>did not</b> use the same behavior or medical evaluations. <br />

This is to inform you that I am in receipt of your letter dated October 30, 2007 which was written in response to a request I made for copies of all 2002, 2003 and 2006 Annual Rabies Activity Reports submitted to the California Department of Health Services ("CDHS") by the Inland Valley Humane Society ("IVHS"). <br />
<br />
Upon initial review of your response made on behalf of IVHS, you reveal an undocumented fact about how IVHS has been recording the disposition of animals (cats and dogs) entering the shelter. This fact was not apparent while compiling data from the various California shelters used in shelter comparisons published on the sheltertrak.com website; nor was this fact known anytime prior to receiving your letter. <br />
<br />
Given this understanding of how IVHS records the disposition of animals, it is agreed that shelter comparisons made on sheltetrak.com fail to produce an accurate overall picture when the IVHS numbers are included. In order to maintain the quality and accuracy of information presented on sheltertrak.com, IVHS has been removed from shelter comparisons being made on sheltertrak.com effective Saturday, November 10, 2007.<br />

The assertions, questions and reasons stated in your letter supporting the advice you have given your client (IVHS) to not comply with my request for documents that IVHS has submitted to the California Department of Health Services, which contain information recorded with and is currently available to the general public from the State of California, suggests you have not reviewed the sheltertrak.com website entirely and have narrowly focused your attention on content related only to IVHS. The <b>Inland Valley Humane Society will NOT provide copies of the Annual Rabies Activity Reports it is required to submit to the California Department of Health Services as requested in a Public Records Act Request</b> per Ms. Bonnie Lutz, Esq. for the following reason;<br />

<div style="background-color: white; border: thin solid rgb(170, 148, 80); padding: 1em; text-align: justify;">IVHS is not a local agency as defined in Government Code section 6252 because it is not a, "county; city; city and county; school district; municipal corporation . . ." IVHS is also not a, "legislative body of a local agency pursuant to subdivisions (c) and (d) of section 54952." IVHS is a private, non-profit corporation. Its Board of Directors is not assigned by any government agency. Consequently, because IVHS is not a local agency, it is not subject to the California Public Records Act.</div><br />

The <b>Inland Valley Humane Society will NOT provide copies of the Annual Rabies Activity Reports it is required to submit to the California Department of Health Services as a "Matter of Public Interest"</b> for numerous reasons but primarily because after reviewing information published on the Sheltertrak.com website Ms. Lutz believes I have at best engaged in creative accounting and at worst, deliberately skewed the numbers in order to slander the Inland Valley Humane Society. <br />
<br />
Ms. Lutz claims I have no concept of how the Inland Valley Humane Society ("IVHS") functions compared to other agencies and that the "statistics" are invalid because they don't represent all animals taken in by IVHS. Only the animals for San Bernardino County service areas are shown but IVHS also handles animals for cities in Los Angeles County which are not being shown.<br />
<br />
Ms. Lutz claims publishing the IVHS numbers without extensive explanation about how IVHS tracks adoptions is irresponsible and "possibly actionable as slander".<br />
<br />
Ms. Lutz claims I have provided false information regarding the percent of animals euthanized and have made no effort to provide data stating the reasons for euthanasia. Sheltertrak.com's emphasis on the euthanasia of cats and dogs without considering the reasons for euthanasia is both irresponsible and inflammatory.<br />
<br />
Ms. Lutz claims IVHS data represented on Sheltertrak.com was provided by a Ms. Nancy Ruddock who acquired this information from IVHS under false pretense. Had IVHS known that this information would be forwarded to me for posting on Sheltertrak.com they would not have provided Ms. Ruddock with the data.<br />
<br />
Ms. Lutz questions the purpose of the Sheltertrak.com website and asks what exactly is the purpose of tracking the progress of shelters. <br />
<br />
Ms. Lutz states Sheltertrak.com has no purpose other than to inflame readers regarding the number of animals euthanized and should be used to educate the public about adopting animals from shelters and about the importance of spay and neuter in order to reduce pet overpopulation.<br />
<br />
Ms. Lutz asks if the goal of Sheltertrak.com is to reduce euthanasia. Ms. Lutz asks if the goal of Sheltertrak.com is to increase the number of animals who are adopted and suggests educational materials on how the public can help these processes should be made available on the Sheltertrak.com website.<br />
<br />
Ms. Lutz also suggests that Sheltertrak.com could be used to inform the public about the quality and quantity of services provided by IVHS rather than attempt to slander IVHS.<br />
<br />
Ms. Lutz concludes her letter by saying any attempt to portray IVHS other than a state of the art, fully compliant, fully functional animal shelter is slanderous.<br />

From small issues to large, they completely disregarded the audit reports. Chief Board Member Tony Barba even stated that while some of the suggestions from AMRT were good, others were going to have to be adapted or disregarded all together because "some of the ideas may work for big cities, but not for them." The report was specifically tailored for Kings County- expressing this thought opens up the idea that the Board/Sheriff's Dept. knows better than AMRT and that some of their ideas are not good ones.</span><br /><br /><span style="color: navy;">In short, the county paid $30,000 for audits that they are not willing to use because they think they know better than the experts who have evaluated the shelter. They could not be more wrong.</span><br /><br /><span style="color: navy;">Here's a list of the recommendations and the the response of the Sheriff's Department, word for word from their proposal: (I put the legal violations first, the others just show their lack of commitment)</span><br /><br /><b>11. Stop using drop boxes. Keep boxes locked during normal business hours.</b><br /><p style="margin-left: 1em;"><br /><i>The drop boxes are locked during normal business hours. This requires anyone wishing to deposit an animal at Animal Services to come in and complete the required paperwork. We are replacing the existing, antiquated drop boxes with new stainless steel boxes. Discontinuing the use of the boxes all together would remove a service that the public has come to expect and could equate to more "dumped" animals.</i><br /><br /><span style="color: navy;"> The Sheriff did NOT mention that both of the audits strongly recommended stopping usage of the drop boxes. When I spoke with him afterward, he stated that they were not illegal and they would be keeping them. AMRT did a great job of emphasizing how extremely hot/cold the drop boxes can get and UC Davis outlined how they are "impossible" to properly keep clean.</span></p><br /><br /><b>33. Do not perform owner-requested euthanasia unless the animal meets specific requirements.</b><br /><br /><p style="margin-left: 1em;"><i>These would be old, injured, sick animals. All other dogs that are healthy and in good condition would be held for adoption.</i><br /><br /><span style="color: navy;">This is illegal! They have to hold all animals for a minimum holding period unless they are irremediably suffering. The law specifically states that old and injured animals are adoptable. What they are saying is that they will continue to "sell" euthanasia and anyone with an old dog can bring it in and have it euthanized that day. This is in complete violation of the holding period mandated by law.</span></p><br /><br /><b>60. Develop procedures for scanning vicious/aggressive animals.</b><br /><br /><p style="margin-left: 1em;"><i>We scan all animals upon intake.</i><br /><br /><span style="color: navy;">This is not true - AMRT made this recommendation because KCAC submitted a kennel card to them on which Norma stated she couldn't scan the cat because it was feral and euthanized it. AMRT raised an excellent point- why wasn't the cat scanned when it was sedated prior to euthanasia? It's perfectly easy to do it then.</span></p><br /><br /><b>67. Do not impose $50 surrender fee.</b><br /><br /><p style="margin-left: 1em;"><i>The fee is viewed as a way to force pet owners to become more responsible for their pets, and not consider them as disposable. This is a new fee, and we believe that it is a good idea.</i><br /><br /><span style="color: navy;">Is this legal? Can they charge a fee as a county-run shelter? If it is legal, it's a terrible idea. Why is it that closing the drop boxes will "encourage the dumping of animals," but not charging a $50 fee?<br />Earlier this year we related the story of Animal Control's charge of $50 to pick up stray animals. A man wanted a feral cat and her kittens removed from her washroom and because they were going to charge him $50, he hit her over the head with a shovel and dumped her and the litter in an alley. This is what's going to happen with the owner surrender fee.</span></p><br /><br /><b>71. Change the 2007-2009 master fee schedule amounts for redeemed animals to apply to unspayed and unneutered animals only.</b><br /><br /><p style="margin-left: 1em;"><i>Will review.</i><br /><br /><span style="color: navy;">The law specifically dictates that impounded animals who are unspayed/unneutered have an additional fee tacked on. They are currently not doing so- charging the same impound fees for all animals.</span></p><br /><br /><b>16. Two people should participate in euthanasia per the National Animal Control Association’s policy statement. Logs should have place to add impound number from animal. Remove euthanized animal after verifying death.</b><br /><br /><p style="margin-left: 1em;"><i>Our euthanasia procedure is within the guideline of state law and statutes.</i></p><br /><br /><b>19. Establish that spay and neuter is a priority.</b><br /><br /><p style="margin-left: 1em;"><i>While it is certainly agreed that spay and neuter is a priority, animal control also wishes to educate the public that this is as much a person problem as it is an animal problem.</i></p><br /><br /><b>29. Work with Chameleon to ensure each animal's correct available date is recorded in the system. Consider displaying each animal's euthanasia date on the kennel card.</b><br /><br /><p style="margin-left: 1em;"><i>It is our goal to use chameleon to its fullest capacity. Although an animal's holding period may have expired that does not mean that is its euthanasia date. Listing a "date of death" seems macabre; we list an available date on kennel cards.</i><br /><br /><span style="color: navy;">This is absolutely not true- AMRT pointed out that available dates of all owner surrenders were incorrect . . . and they still are! Available dates for litters are incorrect and almost all of the animals are killed the morning that they are legally able to do so.</span></p><br /><br /><b>39. Prior to euthanasia, release animals to rescue groups. Designate an employee to work with rescue groups. Establish cooperative agreements with rescue groups.</b><br /><br /><p style="margin-left: 1em;"><i>It has always been our position that rescue can take every animal in the shelter, if they are available.</i><br /><br /><span style="color: navy;"> This is absolutely untrue- we have had more trouble than we've ever had when we've tried to rescue recently. We have since stopped rescuing from them because they make it so difficult with their snotty attitudes and arbitrary rules.</span></p><br /><br /><b>55. Establish outreach programs to provide humane education. Represent the shelter at local events. Reach out to the community with monthly column, advertisements, etc. Consider a newsletter. Hold occasional fundraisers at the shelter.</b><br /><br /><p style="margin-left: 1em;"><i>It is our intention to provide education to the public on humane issues. Also we want to publicize Animal Services as a place to look for and adopt a pet. We would not want to hold a fund raiser at Animal Services for liability reasons and because fund raising for local government seems odd.</i></p><br /><br /><b>58. Begin a trap, neuter, release program in communities with a large number of feral cats. Let the public know the shelter will work with feral cat givers.</b><br /><br /><p style="margin-left: 1em;"><i>We currently treat feral cats within the guidelines and parameters of state law and regulations. The County will not adopt a feral cat "trap and release" program.</i></p><br /><br /><b>64. Vaccinate all animals on intake.</b><br /><br /><p style="margin-left: 1em;"><i>Dogs are vaccinated upon intake, cats are not. Records indicate that cats are received by animal control in large numbers but are not adopted the same way. Vaccination of cats is not an issue to maintain current Animal Services feline population healthy. We do vaccinate prior to adoption.</i></p><br /><br /><b>73. Establish a "healthy" area for animals that we know will leave shelter soon after arrival. As a division of the Sheriff's Office any Animal Control specific Mission/Value statement adopted should contain some relevant parts of the Sheriff's Office Mission statement relevant to "customer service." Also verbiage regarding the ethical and humane treatment of animals.</i></p><br /><br /><b>4. Adopt a logo rather than a Sheriff's star. Something like a cute animal head.</b><br /><br /><p style="margin-left: 1em;"><i>Currently all Animal Control vehicles have a small Sheriff's Office star and the words Animal Control on them. The Sheriff's star on the side with the words "Kings County Animal Services" would accurately reflect the department. Three days later Executive Director William C. Harford replied stating provisions of the California Public Records Act, Government Code sections 6250-6276.48 do not apply because the IVHS does not fit the definition of a "state agency" or a "local agency".<br /><br />IVHS is a private non-profit organization and is contracted with cities to provide each city with a public animal shelter (public pound). Two of the city contract agreements have been reviewed and basically state the following...<br /><br /><i>"Humane Society will perform certain services as set out herein to provide City with public animal shelter (public pound) and animal control services including, but not limited to, the services defined in the CA Food and Agricultural Code sections 30501, et seq., and as specifically described in the Scope of Services herein and contained in Exhibit 1. Those services include the maintenance and operation of an animal shelter (public pound) in compliance with the provisions of applicable sections of the CA Code of Regulations...."</i><br /><br />CALIFORNIA GOVERNMENT CODE<br />SECTION 6250-6270<br /><br />6250.
